Course description
NOT 2008. Comparative Criminal law explores the conceptualisation of criminal law and the approaches used for ensuring criminal justice across the legal traditions of the world. The focus will be on five traditions: two are from the West, in the tradition of the common law and civil law (including the Socialist variant); one will be the religiously informed Islamic law; another is the Confucian or East Asian legal tradition; and, the chthonic legal tradition, in particular where such systems have survived to the present day. From this foundation, specific forms of conduct and issues of criminal responsibility will be analysed from the perspective of each of these five traditions.
