Course description
NOT 2009. This course will emphasize the importance of critical analysis in the area of comparative law. The course will challenge students in their own perception of the social functions of legal rules by drawing their attention to fundamental problems which confront the legal rule in every legal system and the way these problems are responded to by particular legal systems. The course will examine the analytical tools used in comparative law; the study of some ancient or primitive legal systems to tease-out students' comprehension of the content and purpose of modern legal systems, and such issues as the sources of legal systems, judicial interpretation or judicial review.
