Course description
This course is an advanced examination of native title law in Australia. It deals with the common law concept of native title, as recognized in the High Court decisions in Mabo and Wik, and the statutory regimes for dealing with native title under the Native Title Act 1993 (Cth). While the course focuses primarily on the issues relating to land rights and resource management on native title lands in Australia, it also incorporates some comparative materials from other common law jurisdictions by way of illustration without full analytical comparison.
