Course description

This unit examines the admissibility & use of evidence in civil & criminal trials. The primary focus is on Qld law, but comparisons will be drawn with the uniform evidence law. Topics include: competence & compellability of witnesses, privilege, examination of witnesses, evidence of disposition & character, similar fact evidence, the accused as a witness, burdens & standards of proof, documentary evidence, opinion evidence & prior determination, hearsay evidence, admissions & confessions in criminal cases, illegally obtained evidence & confirmation by subsequent fact, res gestae, corroboration & identification evidence. Students seeking admission to the legal profession must complete this course or its equivalent.
